Terms and Conditions

1. The provider

Datastart Kft. (registered seat: 1091 Budapest, Haller utca 64., Hungary, company registration number: 01-09-726914, VAT number: HU13274355, represented by Peter Kopias, e-mail: office at partyphotopaint dot com), the "Provider", operates the event service and application offered under the name partyphotopaint.com.

2. The service

The Provider supplies an AI-powered drawing and photo game for events. Guests draw or have their photo taken. The app creates a written critique and an AI-generated version of each picture, then adds them to a gallery and guest book. The individual quote sets out what is included in the package, such as devices, on-site staff, an album and branding.

3. Contract and fees

The Client requests a quote, which the Provider prepares for the event. A contract is formed when the Client accepts the quote in writing by email. The quote sets out the fees and payment schedule. Unless otherwise agreed, 50% is payable in advance and the balance after the event. Fees exclude VAT, which is added where required by law.

4. Cancellation and withdrawal

The Client may cancel free of charge up to 30 days before the event. Between 30 and 8 days the advance is retained; within 7 days the full fee is due, unless the Provider can resell the capacity.

Where the Client is a consumer: under Section 29(1)(l) of Hungarian Government Decree 45/2014 (II. 26.) there is no right of withdrawal for leisure services tied to a specific date. The Client expressly acknowledges this on signing.

5. The Client's obligations

• Provide the venue, power and the internet connection needed, or order them from the Provider.
• Inform guests that photos taken during the game will be processed by AI, and ensure participation is voluntary.
• Act as data controller for the pictures made at the event; the parties sign a data processing agreement.
• Make sure pictures of minors are taken only with the consent of the child's legal representative.
• Moderate the gallery if pictures are projected in public.

6. Prohibited use

The service may not be used to produce unlawful, hateful, sexual, degrading or deceptive content, to take and process a photograph of another person without their consent, or to interfere with the system. The Provider may delete such content and, in serious or repeated cases, suspend the service.

7. The nature of AI content

The app uses artificial intelligence to create text and images for entertainment. The results are deliberately exaggerated and are not factual statements about the people shown. The Provider does not guarantee that every image or text will suit the Client’s preferences. The Client can use the moderation and regeneration tools to review or change the results.

8. Intellectual property

Guests' drawings and photographs belong to the guests and the Client. The Provider uses them only to deliver the event service. The Provider may show pictures as examples of its work or use them in marketing only with the separate written consent of the Client and the guests concerned. The application, the brand name, the logo and the text templates are the Provider's intellectual property.

9. Liability

The Provider's liability is limited to the fee under the contract, except for damage caused intentionally or harming life, bodily integrity or health. The Provider is not liable for delay caused by internet or power outages or by external AI providers; in such a case only a fee proportionate to the service actually delivered is payable. In a force majeure event the parties discuss moving the event.

10. Data protection

Personal data is handled as set out in the privacy notice and in the data processing agreement signed between the parties.

11. Complaints and disputes

Complaints may be sent to our e-mail address; we answer within 30 days. A consumer Client may turn to the conciliation body for their place of residence; the body for the Provider's seat is the Budapesti Békéltető Testület, the conciliation body of the Budapest Chamber of Commerce and Industry (1016 Budapest, Krisztina krt. 99. I. em. 111.; postal address: 1253 Budapest, Pf.: 10.; phone: +36 1 488 2131; e-mail: bekelteto dot testulet at bkik dot hu; bekeltet.bkik.hu). Consumer protection complaints may be made to the competent government office. The contract is governed by Hungarian law.

12. Changes to these terms

The Provider may amend these terms unilaterally. Amendments take effect when published. Existing contracts remain subject to the version in force when they were entered into.
